UAS operators who want to fly outside the requirements of the Small UAS Rule (Part 107) may request a waiver. One waivable section of part 107 includes 107.29 which declares that no person may operate a small unmanned aircraft system during night.
To apply for a waiver, the applicant must provide a set of performance based standards to ensure flight safety. For the 107.29 Daylight Operation waiver (in order to fly at night), one of the standards include:
- Applicant must assure all required persons participating in the sUA operation have knowledge to recognize and overcome visual illusions caused by darkness, and understand physiological conditions which may degrade night vision.
Of the 726 waivers granted and listed on the FAA portal as of May 1, 2017, almost 99% were granted for nighttime operations. Each waiver granted includes these provisions:
- Prior to conducting operations that are the subject of this Waiver, the remote PIC and VO must be trained, as described in the Waiver application, to recognize and overcome visual illusions caused by darkness, and understand physiological conditions which may degrade night vision. This training must be documented and must be presented for inspection upon request from the Administrator or an authorized representative;
